These Terms

These terms apply when you browse yellowsparks.com. They also apply to our free products where no separate terms are provided. By using the site, you agree to use it lawfully and not interfere with its operation or security.

Our Products

We make things we wish already existed. Some of those things live on their own websites, in the Chrome Web Store or on other platforms. A product page, store listing, checkout page or license may include additional terms about the product, its permissions, price, support and use. Those additional terms apply to that product.

Chrome extensions are also subject to the applicable Google and Chrome Web Store terms. We may update, improve, pause or retire a product when it makes sense to do so.

Purchases

If you buy something from us, the relevant checkout or product page will tell you what you are buying, how it is delivered or accessed, and any applicable cancellation or refund arrangements. Nothing in these terms takes away rights you have under consumer law.

Your Data and Backups

You are responsible for checking changes you make and keeping backups of data that matters to you. Although we work to make our products reliable, user error, device or browser issues, synchronisation problems and other system errors can result in lost, changed or corrupted data.

Across all our products, including extensions, websites and other software, any password you set is encrypted and unavailable to us. We cannot retrieve, view, reset or recover a forgotten password, so please save it securely in a trusted password manager.

We cannot guarantee that data can be recovered or restored in those circumstances. Data loss or corruption caused by user error or a system error does not by itself make a purchase refundable. This does not limit any remedy or refund you are entitled to by law, including where we have not met our legal obligations.

Third Party Services

Some product features may rely on third party providers, such as Google, OneDrive or Dropbox, including their OAuth connections and APIs. We cannot guarantee that a provider will continue to support, make available or allow access to the services our products use.

If a provider permanently withdraws support in a way that materially affects a paid feature, the affected purchase will be refundable. We will first make reasonable efforts to replace the provider or offer an alternative so that disruption is kept to a minimum. Nothing in this section limits your statutory consumer rights.

Using the Site

Please do not attempt to gain unauthorised access to the site or our systems, disrupt the service, introduce harmful code, or use the site for anything unlawful. Do not use automated tools to overload or scrape the site in a way that affects other visitors or our service.

Our Work

The Yellow Sparks name, branding, website content, software and visual assets belong to us or our licensors. You may view and use the site for its intended purpose. Please ask us before copying or reusing a substantial part of our work.

Information on the Site

We do our best to keep the site useful and accurate, but information can change and mistakes happen. Nothing on this site is professional financial, investment, legal, medical or other regulated advice. Please make your own decisions and seek appropriate advice where needed.

Availability and Responsibility

We cannot promise that the site or every product will always be available, uninterrupted or error free. To the extent allowed by law, we are not responsible for losses that were not reasonably foreseeable, or for indirect loss arising from use of this site.

Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or your statutory consumer rights.

Third Party Links

We sometimes link to third party sites and stores because they are useful places to find a product. We do not control those services or their content, so their own terms and privacy policies apply.

Changes

We may update these terms when our site, products or legal obligations change. The current version will always be published here with its revision date. If a material change affects a paid product, we will take reasonable steps to let affected customers know where appropriate.

Law and Contact

These terms are governed by the laws of England and Wales. If you are a consumer living elsewhere, you may also have mandatory rights under the laws of your usual residence.
